5 Islamic Law of Adopting A Non-Muslim Kid

Islamic law of adopting a non-Muslim kid based on the law is lawful as long as there is a sentence from the judge by the law that it is permissible to do. But how do Muslims see these phenomena?

It might be rare to adopt a kid that has a different religion. In common Islamic law, the rule of adopting a child should have the same religions as the parents that would be adopting them.

Based on that rule, it is not permissible to adopt a non-Muslim kid based on the government rule and common Islamic rule. How does the Quran say about these facts that sometimes we couldn’t control whoever type of kid that will be adopted?

Despise all of the controversial perceptive about adopting a non-Muslim kid for a Muslim, it is better to think about the child’s needs as an orphan. In one or another way adopting a kid is a laudable thing.

Moreover, a kid is only a kid. They have no idea what they become, even they come from Muslim or non-Muslim parents. Speaking about that, here’s some of the reasons why adopting them is allowed and lawful based on the Quran.

1. It doesn’t Change the Relationship

Adopting a non-Muslim kid in Islamic law is allowed because it has nothing to do with the religion of the kid. Moreover, once again, a kid is only a kid. Despise the fact that adopting a non-Muslim kid is unlawful, there might be not true.

From the Islamic rule, adopting a kid is a laudable thing to do. And it will not change the relationship between the kid and their biological parents or family.

It will be better to take care of the kid as an orphan so they can live as well as other kids do. Moreover, it also mentions on the Quran surah Al Ahzab verse 5 below.

اُدْعُوْهُمْ لِاٰبَاۤىِٕهِمْ هُوَ اَقْسَطُ عِنْدَ اللّٰهِ ۚ فَاِنْ لَّمْ تَعْلَمُوْٓا اٰبَاۤءَهُمْ فَاِخْوَانُكُمْ فِى الدِّيْنِ وَمَوَالِيْكُمْ ۗوَلَيْسَ عَلَيْكُمْ جُنَاحٌ فِيْمَآ اَخْطَأْتُمْ بِهٖ وَلٰكِنْ مَّا تَعَمَّدَتْ قُلُوْبُكُمْ ۗوَكَانَ اللّٰهُ غَفُوْرًا رَّحِيْمًا – ٥

Call them (adopted children) by (using) the names of their fathers; that is just with Allah, and if you do not know their father, then (call them) your brothers and sisters in your religion and your Maula. And there is no sin on you if you err about it, but (which is a sin) what your heart intends. Allah is Forgiving, Most Merciful.” (QS 33:5)

2. It Doesn’t Change the Inheritance Line

Can adopt kids in Islam can inherit? Islamic law of adopting a non-Muslim kid is allowed as long as they are not changing the inheritance line. In a family tree, the biological kid will become the one who gets the inheritance and the will as well as one of the virtues of adoption in Islam.

Adopting the kid, whether is a Muslim or non-Muslim, doesn’t change the fact that they will inherit some of the adopted parents will. It mentions in the Quran surah Al Ahzab verse 6 below.

وَاُولُوا الْاَرْحَامِ بَعْضُهُمْ اَوْلٰى بِبَعْضٍ فِيْ كِتٰبِ اللّٰهِ مِنَ الْمُؤْمِنِيْنَ وَالْمُهٰجِرِيْنَ اِلَّآ اَنْ تَفْعَلُوْٓا اِلٰٓى اَوْلِيَاۤىِٕكُمْ مَّعْرُوْفًا ۗ كَانَ ذٰلِكَ فِى الْكِتٰبِ مَسْطُوْرًا – ٦

People who are related by blood to each other have more rights (inheritance) in the Book of Allah than the believers and the emigrants, unless you want to do good to your brothers (religious). Thus it is written in the Book (of Allah).” (QS 33:6)

3. Making them a Muslim is Better

There is no limit for a kid to become whatever they want. That is why in Islamic law, it is permissible to adopt a non-Muslim kid. Instead of worrying about lawful or unlawful, it is better to take care of them or even make them Muslim. parents also can apply how to teach their kids about Islamic values to the adopting kid and also get some tips on how to teach Salah to toddlers.

It mentions in the Quran surah Al Anfal verse 75 below.

وَالَّذِيْنَ اٰمَنُوْا مِنْۢ بَعْدُ وَهَاجَرُوْا وَجَاهَدُوْا مَعَكُمْ فَاُولٰۤىِٕكَ مِنْكُمْۗ وَاُولُوا الْاَرْحَامِ بَعْضُهُمْ اَوْلٰى بِبَعْضٍ فِيْ كِتٰبِ اللّٰهِ ۗاِنَّ اللّٰهَ بِكُلِّ شَيْءٍ عَلِيْمٌ ࣖ – ٧٥

“And those who believed after that then emigrated and fought with you, then they are among you. People who have kinship relations are partly more entitled to each other (than those who are not relatives) according to the Book of Allah. Indeed, Allah is Knowing of all things.” (QS 8:75)

4. It Doesn’t Change the Mahram

Adopting a non-Muslim kid is allowed to do, and it doesn’t change the Mahram rule that is already written in the Islamic way. The kid will become non-Mahram from the family that adopts them. Besides, parents need to get some tips on how to raise their kids in Islam to teach them about Mahram rules.

They couldn’t become the biological kid so they are not a part of Mahram in the family. It mentions in the Quran surah Al Ahzab verse 4 below.

وَمَا جَعَلَ اَدْعِيَاۤءَكُمْ اَبْنَاۤءَكُمْۗ

“… and He did not make your adopted son your biological son (alone).” (QS 33:4)

5. Keep the Orphan’s Right

As a parent that adopts a kid from non-Muslim, it has the same rule as adopting a Muslim kid which the parents should keep the orphan’s right including all of the wealth they have. It mentions in the Quran surah An Nisa verse 10 below.

اِنَّ الَّذِيْنَ يَأْكُلُوْنَ اَمْوَالَ الْيَتٰمٰى ظُلْمًا اِنَّمَا يَأْكُلُوْنَ فِيْ بُطُوْنِهِمْ نَارًا ۗ وَسَيَصْلَوْنَ سَعِيْرًا ࣖ – ١٠

“Verily, those who eat the property of orphans unjustly, in fact, swallow fire in their bellies and they will enter a blazing fire (hell).” (QS 4:10)

So, there are some reasons about Islamic law of adopting a non-Muslim kid is allowed to do based on the Quran. May Allah give some peace to those who adopt and take care of the orphans.
