4 Rules Of Wasiyyah In Islam

Wasiyyah or well-known as Will is important to keep your prosperity transferred well to your generation. Since a long time ago, making a Wasiyyah has been such a tradition in Islamic culture. And there are differences between the Hibah and Wasiyah.

Wasiyyah will make things clear as the portion of your wealth has distributed properly. That is why you need to make a Wasiyyah in the right rule and make Duas for wealth. In Islamic society, there are some rules of Wasiyyah based on Islamic law in the Quran.

1. Right Point

If you make a Wasiyyah, you should make a wise decision to whom you will share your wealth as your inheritance. That is why it will be better if you make it based on the Quran surah Al Baqarah verse 177.

لَيْسَ الْبِرَّاَنْ تُوَلُّوْا وُجُوْهَكُمْ قِبَلَ الْمَشْرِقِ وَالْمَغْرِبِ وَلٰكِنَّ الْبِرَّ مَنْ اٰمَنَ بِاللّٰهِ وَالْيَوْمِ الْاٰخِرِ وَالْمَلٰۤىِٕكَةِ وَالْكِتٰبِ وَالنَّبِيّٖنَ ۚ وَاٰتَى الْمَالَ عَلٰى حُبِّهٖ ذَوِى الْقُرْبٰى وَالْيَتٰمٰى وَالْمَسٰكِيْنَ وَابْنَ السَّبِيْلِۙ وَالسَّاۤىِٕلِيْنَ وَفىِ الرِّقَابِۚ وَاَقَامَ الصَّلٰوةَ وَاٰتَى الزَّكٰوةَ ۚ وَالْمُوْفُوْنَ بِعَهْدِهِمْ اِذَا عَاهَدُوْا ۚ وَالصّٰبِرِيْنَ فِى الْبَأْسَاۤءِ وَالضَّرَّاۤءِ وَحِيْنَ الْبَأْسِۗ اُولٰۤىِٕكَ الَّذِيْنَ صَدَقُوْا ۗوَاُولٰۤىِٕكَ هُمُ الْمُتَّقُوْنَ – ١٧٧

“That virtue does not turn your face east and west, but it is a virtue of those who believe in Allah, the last day, angels, books, and prophets and give the treasure they love to relatives, orphans , the poor, those who are on their way (travelers), beggars, and to liberate slaves, who offer prayers and perform alms, those who keep their promises when they promise, and those who are patient in poverty, suffering and suffering. and during the war. These are the righteous, and they are the righteous.” (QS 2:177)

2. Right Values

The right values on your distribution wealth are necessary to keep the importance of inheritance in Islam. But, if you are worried that you could not make the right amount, it is better to ask the expert. Do base on the Quran surah An Nisa verses 11.

يُوْصِيْكُمُ اللّٰهُ فِيْٓ اَوْلَادِكُمْ لِلذَّكَرِ مِثْلُ حَظِّ الْاُنْثَيَيْنِ ۚ فَاِنْ كُنَّ نِسَاۤءً فَوْقَ اثْنَتَيْنِ فَلَهُنَّ ثُلُثَا مَا تَرَكَ ۚ وَاِنْ كَانَتْ وَاحِدَةً فَلَهَا النِّصْفُ ۗ وَلِاَبَوَيْهِ لِكُلِّ وَاحِدٍ مِّنْهُمَا السُّدُسُ مِمَّا تَرَكَ اِنْ كَانَ لَهٗ وَلَدٌ ۚ فَاِنْ لَّمْ يَكُنْ لَّهٗ وَلَدٌ وَّوَرِثَهٗٓ اَبَوٰهُ فَلِاُمِّهِ الثُّلُثُ ۚ فَاِنْ كَانَ لَهٗٓ اِخْوَةٌ فَلِاُمِّهِ السُّدُسُ مِنْۢ بَعْدِ وَصِيَّةٍ يُّوْصِيْ بِهَآ اَوْ دَيْنٍ ۗ اٰبَاۤؤُكُمْ وَاَبْنَاۤؤُكُمْۚ لَا تَدْرُوْنَ اَيُّهُمْ اَقْرَبُ لَكُمْ نَفْعًا ۗ فَرِيْضَةً مِّنَ اللّٰهِ ۗ اِنَّ اللّٰهَ كَانَ عَلِيْمًا حَكِيْمًا – ١١

“Allah prescribes (obliges) you about (the distribution of inheritance to) your children, (that is) the portion of a son is the same as the part of two daughters. And if the child is all more than two women, then their share is two-thirds of the assets left behind. If she (a daughter) is just one, then she gets half (the property left). And for the two ladies and gentlemen, each share one-sixth of the assets left, if he (the deceased) has children. If he (the deceased) has no children and he is inherited by his two mothers (only), then his mother gets a third. If he (who died) has several siblings, then his mother gets one sixth. (Divisions mentioned above) after (fulfilled) the will made or (and after being paid) the debt. (About) your parents and your children, you do not know which of them has more benefits for you. This is God’s decree. Truly, Allah is All-Knowing, All-Wise.” (QS 4:11)

3. Right Proportion

Not only you have to share your wealth with your inheritance at the right point and value, but also the right proportion. Such mentions in the verses below as the right inheritance in Islam for women.

وَلَكُمْ نِصْفُ مَا تَرَكَ اَزْوَاجُكُمْ اِنْ لَّمْ يَكُنْ لَّهُنَّ وَلَدٌ ۚ فَاِنْ كَانَ لَهُنَّ وَلَدٌ فَلَكُمُ الرُّبُعُ مِمَّا تَرَكْنَ مِنْۢ بَعْدِ وَصِيَّةٍ يُّوْصِيْنَ بِهَآ اَوْ دَيْنٍ ۗ وَلَهُنَّ الرُّبُعُ مِمَّا تَرَكْتُمْ اِنْ لَّمْ يَكُنْ لَّكُمْ وَلَدٌ ۚ فَاِنْ كَانَ لَكُمْ وَلَدٌ فَلَهُنَّ الثُّمُنُ مِمَّا تَرَكْتُمْ مِّنْۢ بَعْدِ وَصِيَّةٍ تُوْصُوْنَ بِهَآ اَوْ دَيْنٍ ۗ وَاِنْ كَانَ رَجُلٌ يُّوْرَثُ كَلٰلَةً اَوِ امْرَاَةٌ وَّلَهٗٓ اَخٌ اَوْ اُخْتٌ فَلِكُلِّ وَاحِدٍ مِّنْهُمَا السُّدُسُۚ فَاِنْ كَانُوْٓا اَكْثَرَ مِنْ ذٰلِكَ فَهُمْ شُرَكَاۤءُ فِى الثُّلُثِ مِنْۢ بَعْدِ وَصِيَّةٍ يُّوْصٰى بِهَآ اَوْ دَيْنٍۙ غَيْرَ مُضَاۤرٍّ ۚ وَصِيَّةً مِّنَ اللّٰهِ ۗ وَاللّٰهُ عَلِيْمٌ حَلِيْمٌۗ – ١٢

“And your share (husbands) is half of the wealth left by your wives, if they do not have children. If they (your wives) have children, then you get a quarter of the property that they leave after (fulfilling) the will they made or (and after being paid) their debt. Wives get a quarter of the wealth you leave if you don’t have children. If you have children, the wives get one-eighth of the assets you left (after fulfilling) the will you make or (and after you have paid) your debts. If a person dies, both male and female who do not leave the father and do not leave the child, but have a brother (a thousand) or a sister (a thousand), then for each of the two types of siblings one-sixth of the treasure. But if the thousand brothers are more than one, then they are together in the third portion, after (filled with a will) which he made or (and after being paid) with no distress (to the heirs). Such is God’s provision. Allah is All-Knowing, All-Counselor.” (QS 4:12)

4. Declare Your Wasiyyah Properly

Once you make a Wasiyyah, you should declare it among your family member. It is obligatory so that your family member, includes your wife and son or daughter will know it.

Such as mentions in the Quran, surah Al Baqarah verse 180.

كُتِبَ عَلَيْكُمْ اِذَا حَضَرَ اَحَدَكُمُ الْمَوْتُ اِنْ تَرَكَ خَيْرًا ۖ ۨالْوَصِيَّةُ لِلْوَالِدَيْنِ وَالْاَقْرَبِيْنَ بِالْمَعْرُوْفِۚ حَقًّا عَلَى الْمُتَّقِيْنَ ۗ – ١٨٠

“It is obliged upon you if death is about to pick up someone among you, if he leaves the property, wills to both parents and close relatives in a good way, (as) an obligation for the righteous.” (QS 2:180)
