13 Proper Rights of Inheritance in Islam for Women

According to the view of Islam, women and men have same rights, such as in works, treasures, and ownership. Similarly in the matter of inheritance, men and women have same right in there. Islam has arranged about the rules of inheritance where it is explained in the words of Allah Subhanahu Wa Ta’ala below :

“For men is a share of what the parents and close relatives leave, and for women is a share of what the parents and close relatives leave, be it little or much – an obligatory share.” (Q.S. An-Nisa : 7)

 

“Allah instructs you concerning your children : for the male, what is equal to the share of two females. But if there [only] daughters, two or more, for them is two thirds of one’s estate. And if there is only one, for her is half. And for one’s parents, to each one of them is a sixth of his estate if he left children. But if he had no children and the parents [alone] inherit from him, then for his mother is one third. And if he had brothers [or sisters], for his mother is a sixth, after any bequest he [may have] made or debt. Your parents or your children – you know not which of them are nearest to you in benefit. [These shares are] an obligation [imposed] by Allah. Indeed, Allah is ever Knowing and Wise.” (Q.S. An-Nisa : 11)

 

“And for you is half of what your wives leave if they have no child. But if they have a child, for you is one fourth of what they leave, after any bequest they [may have] mad or debt. And for the wives is one fourth if you leave no child. But if you leave a child, then for them is an eight of what you leave, after any bequest you [may have] made or debt. And if a man or woman leaves neither ascendants nor descendants but has a brother or a sister, then for each one of them is a sixth. But if they are more than two, they share a third, after any bequest which was made or debt, as long as there is no detriment [caused]. [This is] an ordinance from Allah, and Allah is Knowing and Forbearing. “ (Q.S. An-Nisa : 12)

 

“And for all, We have made heirs to what is left by parents and relatives. And to those whom your oaths have bound [to you] – give them their share. Indeed Allah is ever, over all things, a Witness.” (Q.S. An-Nisa : 33)

 

“And they request from you, [O Muhammad], a [legal] ruling concerning women. Say, “Allah gives you a ruling about them and [about] what has been recited to you in the Book concerning the orphan girls to whom you do not give what is decreed for them – and [yet] you desire to marry them – and concerning the oppressed among children and that you maintain for orphans [their rights] in justice.” And whatever you do of god – indeed, Allah is ever Knowing of it.” (Q.S. An-Nisa : 127)

 

“They request from you a [legal] ruling. Say, “Allah gives you a ruling concerning one having neither descendants nor ascendants [as heirs].” If a man dies, leaving no child but [only] a sister, she will have half of what he left. And he inherits from her if she [dies and] has no child. But if there are two sisters [ or more], they will have two-thirds of what he left. If there are both brothers and sisters, the male will have the share of two females. Allah makes clear to you [His law], lest you go astray. And Allah is Knowing of all things.” (Q.S. An-Nisa : 176)

Rights of Inheritance For Women

  1. If an inheritor (died person) only has a son and a daughter, then his inheritance is divided for them. A son get two parts, while a girl get one part.
  2. If there are many heirs consist of sons and daughters, then a part of son is twice from part of girls.
  3. If besides children, there is also ashhabul furudh like a husband or a wife, a father or a mother, then inheritance should be given to ashhabul furudh first. After that, the rest of inheritance is divided to children.
  4. If an inheritor only leaves one son, then that son inherits all of inheritance. Although there is no verse that confirms about that, but we can see that a part of son is twice part of daughters, if there is only one daughter, she will get a half of inheritance. So that, it can be concluded that if the heir is only one son, then he will get all of that inheritance.
  5. A father and a mother each get a sixth part of inheritance if a inheritor has descendants.
  6. If an inheritor does not have descendants, then his mother will get third part of inheritance.
  7. If an inheritor also has two siblings or more, then his mother get sixth part of inheritance. While his father get five sixths part of inheritance. And his siblings do not get his inheritance because there is still his father as hajib (blocker) based on the law of inheritance in Islam. [AdSense-C]
  8. If a husband dies, and he does not have a hild (descendant), then part of wife is quarter of inheritance.
  9. If a husband dies and he has children (descendants), the his wife get an eighth of inheritance.
  10. If someone dies and he has one brother of the same mother or one sister of the same mother, then they will get a sixth of inheritance.
  11. If a person who die has two or more brothers or sisters of the same mother, they get two-thirds of inheritance and it is divided evenly.
  12. If a person died and he does not have a father or children, but he has only one sister of the same father, then the heir get a half of inheritance.
  13. If the inheritor has two sisters of the same father to the top and he does not have a father and children, then the heirs get two-third that are divided evenly.
