20 Importance of Judiciary in Islam – Useful Systems

It is a human nature that a man cannot live on their own. He need to live within the society to comply one another. Because people continue to live side by side everyday, friction is unavoidable. When one’s personal interest doesn’t match with the other, conflicts would inevitably break out. There are could be a possibility that one side is strong while the other side is weak.

Law and justice exist to protect both rights and make sure that no one is violating the rights of another. Islam is a religion that value justice very highly. Here are the importance of judiciary in Islam everyone should know:

1. To Create a Peaceful Life for Every Muslim

Social life could never possibly going smoothly without any troubles. While some people are live accordingly and never go beyond the law, there are also some people who have different interest and ruin it. Friction and conflict are unavoidable. This is why we need the judiciary. To make sure that everyone live according to the law and never to break it. Thus we can have a peaceful and happy life.

“O mankind, We have created you male and female, and appointed you races and tribes, that you may know one another”. (49:13)

And other,

“God’s responsibility is to show the way; and some do swerve from it. If He willed, He would have guided you all together”. (16:9)

2. To Protect the Weak Member of the Society

When people from the society conflicted, the may not be equal. One side is strong, aggressive, and have the force. While the others are weak and cannot stand for themselves. Judiciary must not be in favor of anyone, including the weaker. But it has to make sure that the rights of the weak are protected and he will be judged fairly according to the law.

“The people were one nation; then God sent forth the prophets, good tidings to bear and warning, and He sent down with them the Book with the truth, that He might decide between the people touching their differences; and only those who had been given it were at variance upon it after the clear signs had come to them, being insolent one to another; then God guided those who believed to the truth, touching which they were at variance, by His leave; and God guides whomsoever He will to a straight path”. (2:213)

3. To Ensure No One is Oppressing Another

When a party feels himself stronger than the other, he may used the strength to break the law. In the hope that everything will be done in his favor. He may oppress the weaker, or even worse, he tries to oppress the law. Things like this should be prevented from happening. It is one of the main reason why judiciary exist, to make sure that no one is oppressing another.

4. It is a Religious Obligations

Islam played a big part of human civilization. It has its own law and rules to organize the life of society. It is an obligation for Islam to ensure that there is rights violation. As for Muslims themselves, live according the rule and not to break them is also an obligations as well.

5. It Shows Islam Concern Toward Justice

Islam is widely known as a religion that sets rules for every aspects in life, including economy, politics, and daily life. To make sure that everything is going within the law and the social balance is never disrupted, Islam also established its own law. The fact that Islam even has its own law and justice shows how much Islam always concerns in every aspects of life.

6. Following the Initial Acts of the Prophet

During the time after hijrah to Medina, many Muslims usually came to the Prophet when conflicts arise. They asked the Prophet to judged matters in their daily life. Not only in Medina, the Prophet was often summoned to other city to settle some troubles. Judiciary has judged to settle the matters, just like what our Prophet did in the past. Judiciary is a form of sunnah in modern days, mirroring the acts of the Prophet in the early Islamic days.

7. To Set a Guideline in Life

If we want a balanced life, then a guideline must be set to make sure everyone walked within it. So that in everything people do in life, they always look up to the law and make sure that their own acts never gone beyond them. Do something outside the guideline means breaking the law, and it brings consequences  that one can never imagine.

“So when their Messengers brought them the clear signs, they rejoiced in what knowledge they had, and were encompassed by what they mocked at.” (40:83)

8. Implying the Quran and Sunnah on Daily Life

Islamic laws, rules, and justice are all established based on Quran and Sunnah. As Allah SWT and His Messenger has sets major rules, it was being broken down is more details, to make sure that everything is covered and to prevent the unwanted thing from happening in the future. Thus, the judiciary makes sure that Muslim will always live within the guide of Allah SWT and His Prophet, to make a better society life.

9. A Necessity to Develop a Nation

A nation should be established under the law. It is to prevent criminal, violation, and other good deeds. To create a peaceful nation and a good society, law and justice are needed. So the society could have a civilized society that living within the law and not break them. When the law doesn’t exist, the peaceful live of the society is impossible.

10. It is a Responsibility to Islam

Islam has responsibility to protects its followers. Islam has to make sure that people in a society is living peacefully. Islam has to make sure that no Muslim can ride another Muslim for his interest. In a short way, Islam is responsible for life of Muslims. The responsibility is manifested through the law, where even the smallest matters and aspects in life are set.

“Indeed we sent Our Messengers with the clear signs, and We sent down with them the Book and the Balance so that men might uphold justice. And We sent down iron, wherein is great might, and many uses for men, and so that God might know who helps Him, and His Messengers, in the Unseen. Surely God is All-Strong, All-Mighty”. (57:25)

And whatever you are at variance on, the judgement thereof belongs to God. That then is God, my Lord; in Him I have put my trust, and to Him I turn penitent. (42:10)

More Importance of Judiciary in Islam

  1. To make sure the social order won’t be disrupted.
  2. To maintain the correct order in every aspects of life.
  3. To make a peaceful living for every Muslims.
  4. To be a safeguard in social unity.
  5. To curb the deviated behavior that could be a threat for society.
  6. To remove disagreement and to solve dispute.
  7. To maintain the balance in the daily life of society.
  8. To prevent the harm of rights of the people.
  9. To set the dispute between people and the government.
  10. To cement Islam status as a fair religion.

So those are the importance of judiciary in Islam. Islam is indeed a comprehensive religion that has set the rule for every aspects in human life. As Islam loves peace and wants every Muslim to live i peace, Islamic law and judiciary are therefore established. Let’s all live fairly and following the law. It is for our own sake happiness, so let’s not being selfish and acts on our own.
