Prohibition of Drugs in Islam – Law – Quran Verses

Islam is very concerned with the welfare of the body of his people. Precisely in the health aspect of Muslims are ordered to keep the body mandated by Allah SWT in order to always be in a healthy condition, in addition to ordering human beings seek in medicine when exposed to the disease.

Definition of Drugs

Medication, or drugs is something that can cure us of an illness suffered. Drugs in the broad sense are chemicals that can affect the life process and are used with certain doses, in the hope of preventing and curing of a disease.

Drug Abuse in Islamic View

Types of Drugs

1. Narcotics

Natural narcotics are medicines derived from plants. Some examples of natural narcotics, namely morphine, cocaine, heroin, opium (opium), Cannabis, Marijuana, katinon (plant khat), and so on. While narcotic synthesis is a drug that is synthesized from artificial chemicals (non-natural). Some examples of narcotic synthesis are pethidine, methadone, naltrexon, propoxyphene (darvon) and so on.

2. Psychotropic

Psychotropic drugs are dangerous, can damage the central nervous system in the brain and disturb the psychic or mental person. Some psychotropic examples such as Amphetamine Type Stimulants (ATS), Methamphetamine, Ecstasy (huge drug / inex), Benzodiazepines (coplop pills, lexotan), and so on. 3. Addictive Substance

Addictive substances are a group of drugs other than narcotics and psychotropic substances. Use of this substance is also dangerous, trigger dependence and disrupt the workings of the brain. Examples of addictive substances such as nicotine, alcohol, sedatives, and the like.

Why Drugs are Forbidden?

Taking drugs without any reason (emergency), the scholars agree that the law is haram. Ibn Taimiyah rahimahullah in Majmu ‘al-Fatawa 34: 204 says

“Drugs as well as substances that intoxicating and forbidden under the agreement of the scholars. Even any substance that can rid the mind, it is unlawful to consume even if not intoxicating”.

In Al-qur’an, there are some of verse that implicitly explaining about the prohibition of drug use. First verse is come from Al-a’raaf verse 107 :

‘Those who follow the Messenger, the unlettered prophet, whom they find written in what they have of the Torah and the Gospel, who enjoins upon them what is right and forbids them what is wrong and makes lawful for them the good things and prohibits for them the evil and relieves them of their burden and the shackles which were upon them. So they who have believed in him, honored him, supported him and followed the light which was sent down with him – it is those who will be the successful.’

In the verse it is very clear that anything that has a negative / negative effect is forbidden by Islam and drugs is also very clearly has a harmful negative effect. The next verse comes from Surat Al-Baqarah verse 195 and An-Nisa verse 29 :

  • And spend in the way of Allah and do not throw [yourselves] with your [own] hands into destruction [by refraining]. And do good; indeed, Allah loves the doers of good.’ (2:195)
  • ‘O you who have believed, do not consume one another’s wealth unjustly but only [in lawful] business by mutual consent. And do not kill yourselves [or one another]. Indeed, Allah is to you ever Merciful.’ (4:29)

Punishment or Sanctions for Using Drugs

As for sanctions or penalties for non-drug users in the framework of treatment according to the Majority of Jurisprudence experts is a ta’zir penalty adjusted to the benefit according to government policy. Even in this context, according to Fuqaha Hanafiyah and Malikiyah, the government can enforce the death penalty if the case is repeated and the perpetrator is not deterred from punishment other than that. Shaykh Wahbah az-Zuhaili said: [AdSense-C]

‘The Fuqaha Hanafiyah and Malikiyah allow sanctions of takzir in the form of capital punishment termed al-qatl siyasah (capital punishment). That being said, when the judge dismisses him as a benefit in related matters and the type of crime lays down the death penalty, such as recurring or continuing to consume liquor and narcotics.’

There is also the law of distributing narcotics by selling, buying, smuggling, and similar to the law of producing, which is haram because it belongs to the category of facilitating the immoral (i’anah ‘ala ma’shiyah), which is also included in the announcement of the prohibition of al-Qur’an Surah Al-Maa’idah verse 2:

‘O you who have believed, do not violate the ritual of God or [the sanctity of] the sacred month or [neglect the marking of] the sacrificial animals and garlanding [them] or [violate the safety of] those coming to the Sacred House seeking bounty from their Lord and [His] approval. But when you come out of ihram, then [you may] hunt. And Masjid al-Haram leads you to transgress. And cooperate in righteousness and piety, but do not cooperate in sin and aggression. And fear Allah; indeed, Allah is severe in penalty.’

That was the explanation about Drugs in Islamic view. Obviously, drugs are prohibited if it is used not in the right place.  However, sometimes some types of drugs included in drugs or drugs are needed for sick people to treat wounds or to reduce pain. This is an emergency. And in those circumstances it is still permissible to remember the method often raised by the scholars :

“The state of emergency allows forbidden things”
